JOMO Photo & Video LLC – Terms and Conditions

By engaging the services of JOMO Photo & Video LLC ("Company"), you ("Client") agree to the following terms and conditions. These terms are designed to ensure a clear understanding of our services and to protect the interests of both parties.
1. Media Delivery

Delivery Timeline: Media delivery times vary based on the services rendered. While we strive for prompt delivery, certain services may require additional processing time.

Staggered Delivery: Different media types (e.g., photos, videos, floor plans) may be delivered at different times.

Notification: Clients will be notified upon completion and availability of each media type.
2. Payment Terms

Payment Due: Full payment is required upon receipt of the final invoice.

Access to Media: Media will not be available for download until full payment is received.

Accepted Payment Methods: We accept major credit cards, electronic transfers, and other methods as specified on our invoice.
3. Weather Policy

Inclement Weather: In the event of harsh weather conditions (e.g., heavy rain, storms), certain services or the entire shoot may need to be rescheduled.

Rescheduling: Rescheduling due to inclement weather will be accommodated at the earliest available appointment time at no additional charge to the client.
4. Property Preparation

Client Responsibility: Properties should be clean and ready for shooting at the scheduled appointment time, unless prior arrangements have been made.

Limited Assistance: Our team may assist with minor adjustments but is not responsible for cleaning or extensive staging.

"As-Is" Shooting: If the property is not prepared, we may proceed with shooting "as-is" or reschedule at our discretion.
5. Safety and Rescheduling

Unsafe Conditions: If the property poses a risk to our team (e.g., presence of fleas, smoke, black mold, aggressive animals, or individuals), we reserve the right to reschedule.

Rescheduling Fee: A rescheduling fee may apply in such cases to cover lost time and expenses.
6. Conduct and Professionalism

Mutual Respect: We maintain a zero-tolerance policy for derogatory behavior toward our team members.

Client Concerns: If you believe a team member is not representing our company appropriately, please inform us immediately so we can address the issue.
7. Licensing and Usage Rights

License Grant: Upon full payment, clients are granted a non-exclusive, non-transferable license to use the delivered media solely for marketing the specific property.

Promotional Use: We reserve the right to use media for our own promotional purposes unless otherwise agreed upon in writing.
8. Cancellation and Rescheduling Policy

Advance Notice: Clients may cancel or reschedule appointments without penalty if a minimum of 24 hours' notice is provided.

Late Cancellations: Cancellations or rescheduling requests made within 24 hours of the appointment may incur a fee.

No-Show Policy: If our team arrives at the property and is unable to perform the shoot due to client-related issues, a fee may be charged.

Requested Photographer: As we will alway attempt to honor preferred photographers we reserve the right to change photographer on your job to best serve you as the client.
9. Limitation of Liability

Service Scope: JOMO Photo & Video LLC is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the media provided.

Client Responsibility: Clients are responsible for ensuring the property is safe and accessible at the time of the shoot.
10. Agreement Acceptance
By scheduling an appointment or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.
